Terms and Conditions of Use – Falls Fest

Welcome to Falls Fest. These terms govern your use of our website, digital platforms, and all services provided in connection with Falls Fest events and community initiatives. By accessing or using our services, you agree to comply with and be legally bound by these Terms and Conditions. If you do not agree, please do not use our services.

1. Acceptance of Terms

By using Falls Fest services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and by all applicable federal and provincial laws and regulations. These Terms constitute a binding agreement between you and Falls Fest.

2. Amendments to Terms

Falls Fest reserves the right to update or modify these Terms and Conditions at any time, with or without prior notice. Updated versions will be posted on our website with an updated “Effective Date.” Continued use of our services after changes have been made constitutes your acceptance of the revised Terms.

3. Eligibility to Use Services

You must be 18 years of age or older to use Falls Fest services. By using our website or booking any services, you represent and warrant that you meet this age requirement and are legally capable of entering into a binding agreement.

4. Account Registration

To access certain features (e.g., vendor registration, volunteer sign-up, event ticketing), you may be required to create an account. You agree to provide accurate and complete information and to maintain the confidentiality of your login credentials. You are solely responsible for any activity conducted through your account.

5. Description of Services

Falls Fest provides a platform for organizing, promoting, and participating in community-based, family-friendly halal events across North America. Our services may include but are not limited to:

All services are provided subject to availability and applicable local regulations.

6. Acceptable Use of Services

You agree to use Falls Fest services solely for lawful purposes and in accordance with these Terms and Conditions. You agree not to:

• Impersonate any other person, entity, or falsely claim an affiliation with Falls Fest
  
  
• Violate any municipal, provincial, or federal law or regulation
  
  
• Interfere with the operation, security, or functionality of the website
  
  
• Engage in any activity that could harm Falls Fest, its partners, or other users
  
  

7. Event Participation and Public Sharing

If you submit or publish event-related content (e.g., vendor details, community ads, or images), you agree to:

• Ensure all event information is accurate and lawful
  
  
• Obtain appropriate rights or consents for any content shared publicly
  
  
• Authorize Falls Fest to display and distribute such content on its platforms and promotional materials, where applicable
  
  

8. Payments and Refunds

• All payments are processed securely via trusted third-party providers such as Stripe. By completing your payment, you agree to the terms and conditions set by Falls Fest and the relevant payment gateway provider (e.g., Stripe).

• Refunds will be processed in accordance with the following guidelines and our commitment to customer satisfaction:

  Non-Refundable Fees: Certain service or processing fees may be non-refundable unless otherwise stated or required by applicable law.
  Processing Times: Refunds may take up to 5–10 business days depending on your financial institution.
  

9. Cancellations

We understand that plans can change, and we strive to provide a flexible and fair cancellation policy. Our goal is to ensure that all attendees have a smooth and positive experience with Falls Fest.

• Cancellations made more than 5 days before the event:
  ✅ Full refund of the ticket or vendor fee (excluding non-refundable processing fees, if any).

• Cancellations made between 3 and 5 days before the event:
  ✅ 50% refund of the ticket or vendor fee.

• Cancellations made within 2 days of the event:
  ❌ Tickets and vendor bookings are non-refundable at this stage, as operational costs are fully committed.

Falls Fest reserves the right to cancel or reschedule events. In such cases, affected users will be notified promptly, and refund options will be provided where applicable.

10. Intellectual Property Rights

All materials available through Falls Fest platforms, including but not limited to logos, trademarks, text, graphics, images, and software, are the intellectual property of Falls Fest or its licensors. Unauthorized use, reproduction, or distribution of any content is strictly prohibited.

11. Limitation of Liability

To the fullest extent permitted by law, Falls Fest and its affiliates, employees, contractors, and agents shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or goodwill arising from:

• Use of or inability to use the services
  
  
• Any third-party content or conduct
  
  
• Unauthorized access to or alteration of your data
  
  
• Any disruption or cancellation of an event beyond our reasonable control
  
  

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising out of or related to these Terms or Falls Fest services shall be subject to binding arbitration under the Arbitration Act, 1991 (Ontario). Arbitration shall be conducted in English in Toronto, Ontario.

14. Termination of Access

Falls Fest reserves the right to suspend or terminate access to services or user accounts at its sole discretion, without prior notice, for any reason including, but not limited to, violations of these Terms. Upon termination, all rights granted to you under these Terms will immediately cease.
